BREAKING Constitution Court Spain declares regime’s lockdowns illegal

Spain’s neo-Marxist PSOE junta has been denounced by Spain’s Constitutional Court of twice illegally locking down the nation. As a consequence, the Socialist Workers Party without an appeal must return to Spain’s workers over ONE MILLION fines illegally imposed during the Dr Antoni Fauci sponsored national ordeal.

‘The illegality of the confinement between March and June 2020 nullifies more than a million sanctions.

The official document, where the former judge, Fernando Presencia, is notified, that his complaint against the Minister of Defence, Margarita Robles, for payment and bank deposits, continues to go ahead and without any appeal.

The first unconstitutional state of alarm to face the media-hyped coronavirus pandemic closed with a balance of more than one million fines to citizens who skipped home confinement. The ruling of the Constitutional Court of last July, which declared that general and indiscriminate confinement illegal, for which it would have been necessary to apply a state of exception, nullifies all these sanctions. As media has learned (but keeps quiet about it), the Madrid junta is already processing the first refunds.

For the management of the refunds of the fines, the Government of PSOE and United We Can have launched a working group headed by the Ministry of Territorial Policy.

These sources specify to this newspaper that the working group has already met and has begun to process the first returns, mandatory by the aforementioned Constitutional ruling, which declared the fines void. 

Unpaid fines corresponding to the first state of alarm, which was in effect between March 14 and June 21, 2020, will not be pursued.

‘The money will be returned to ex officio citizens, previously requiring that they identify the bank account number,’ they explain from Territorial Policy. 

The judicial blow to the leftist Madrid regime, which must re-enter the sanctions, joins the foreseeable ruling of the Constitutional Court on the second state of alarm, which is also to declare it unconstitutional for stealing from Congress the ability to effectively control the Executive with the six-month extension. 

According to data provided by the Ministry of the Interior in March this year, a total of 1,142,127 fines were imposed throughout Spain during the first state of alarm.

Of the 481,969 sanction proposal minutes processed, 172,482 had been resolved with a sanction; 87,826 had been transferred to other administrations; 54,193 were in the investigation process; and 11,206 had been filed, according to data updated by Territorial Policy last May. In other words, more than 170,000 fines had already been collected as of May.

Precisely that month, Territorial Policy had announced that it was going to strengthen and speed up the processing of fines due to ‘the disproportionate workload.’ 

The magistrates concluded in their sentence that the measures imposed by Prime Minister Pedro Sánchez not only limited rights, for which the use of a state of alarm is contemplated but that they were suspended, something for which a state of exception is necessary.

Due to the illegally imposed prohibition of free movement, the Constitutional Court saw two other rights suspended in its sentence: that of assembly and that of establishing free residence where each one deems appropriate. Sánchez’s decree established the obligation for Spaniards to remain in their first residence, without the possibility of moving to others of their possession for any reason.

The Constitutional Court established that the general and indiscriminate confinement imposed in the first state of alarm of the pandemic supposed a suspension, and not a limitation, of the right to free movement. 

The Constitutional Court ruling sets a precedent so that in the future home confinement like the one experienced in 2020 with a state of alarm cannot be imposed. This instrument only allows the limitation of rights, not their full suspension.

Interestingly, the successful action against the Madrid regime’s illegal lockdown was initiated and pursued by VOX Party. The nationalist anti-globalist party dubbed ‘far-right’ by liberal media exposed the illegality of the mandates imposed by Spain’s far-left regime. The VOX Party triumph will send shock waves throughout the Western world. Corporate media, sponsored and funded by excessive government advertising is determined to keep a lid on the news of the VOX Party’s victory.
